1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Runnisaidpur P.S. Case no.47 of 2022 registered under sections 304B and 34 of the Indian Penal Code.

3. As per the prosecution case, the daughter of the informant was married to the son of the petitioner herein. It is stated that information was received to the effect that she was being treated in the hospital. On reaching the hospital, the informant states that her daughter informed that she was assaulted by the accused persons including the petitioner herein. The informant's daughter died in course of treatment.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only

Patna High Court CR. MISC. No.20016 of 2023(2) dt.16-05-2023 2/2 on the ground of being father-in-law of the deceased. The allegations are general and omnibus in nature. The son of the petitioner ie the husband of the deceased is in custody since 7.11.2022. The petitioner is in custody since 28.11.2022 and charge-sheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioner who happens to be the father-in-law of the deceased, the husband of the deceased being in custody, the petitioner being in custody for 5 months since 28.11.2022, not having any criminal antecedent and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Runnisaidpur P.S. Case no.47 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
