JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. From perusal of the first information report it would appear that only one bottle of Indian made foreign liquor is said to have been recovered from the house of the petitioner though it is alleged that petitioner had given bottles of Indian made foreign liquor, in huge quantity, to the co-accused Mahendra Sah, which were recovered from the house of co-accused Mahendra Sah, and on the basis of discloser made by the petitioner, in huge quantity, the country made liquor were recovered from possession of other co-accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties and, particularly, keeping in

No.31646 of 2016 (2) dt.16-08-2016 2/2 mind that the alleged recovery was made from possession of different persons and only one bottle of Indian made foreign liquor has been recovered from possession of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudra P.S.Case No. 127 of 2016.
