2. The petitioner is in custody in connection with Pakribarawan P.S Case No. 16 of 2025 registered for the offences punishable under Sections 305 of the BNS, 2023. Later on Section 317(4) of the BNS has been added by learned Magistrate.

3. As per prosecution case, mobile and ornaments were stolen from the house of the informant and two others.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner has got clean antecedent. It is also submitted that petitioner is in judicial custody since 14.01.2025.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order it appears that petitioner is not named in FIR his name surfaced from the confessional statement of the co-accused. No stolen items were recovered from the conscious possession of the petitioner. No test identification parade were conducted during investigation. Investigation is already concluded and accordingly charge-sheet has been submitted.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-II, Nawada in connection with Pakribarawan P.S Case No. 16 of 2025.
