The petitioner seeks bail in connection with N.D.P.S. G.R. Case No.166 of 2015, arising out of Nathnagar (Lalmatiya) P.S. Case No.08 of 2015, registered under Sections 20(B)(C), 23(C) and 25 of the N.D.P.S. Act, pending in the court of the Additional Sessions Judge-IV, Bhagalpur.
The accusation is that in course of search of the house of the petitioner, 89 kilograms Ganja was recovered beneath the bed of the petitioner. At that time, the husband of the petitioner was not at the house.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is lady and has falsely been implicated
Patna High Court Cr.Misc. No.36793 of 2016 (2) dt.24-08-2016 2/2 in this case. In fact, at that time of recovery of the aforesaid Ganja beneath the bed of the petitioner, the husband of the petitioner was outside of the house and she was alone in the house. Having regard to the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
