JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Shri Ram Sumiran Rai, the learned APP for the State. The present petition is by way of second attempt for grant of anticipatory bail inasmuch as the earlier petition filed by the petitioner for grant of anticipatory bail was dismissed as not pressed by an order dated 10.12.2019 passed by this Court in Cr. Misc. No. 35382 of 2019, qua the petitioner herein.
At the outset, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to the
Patna High Court CR. MISC. No.20271 of 2020(2) dt.09-07-2020 2/2 petitioner to surrender before the learned court below and seek regular bail, relying upon the order dated 15.4.2019 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 65241 of 2018, whereby and whereunder the accused person namely Babloo Singh has been granted the privilege of anticipatory bail. Accordingly, the present petition stands disposed of as withdrawn, however, with liberty to the petitioner to surrender before the learned court below and seek regular bail.
