Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Dagarua P.S. Case No. 64 of 2020 registered for offence punishable under sections 341, 376, 506 of the Indian Penal Code, section 4 of the POCSO Act and sections 3/4 of the Dowry Prohibition Act.

The learned counsel for the petitioner has submitted that both the parties have compromised the case. Since the petitioner is privilege with the benefit of

Patna High Court CR. MISC. No.30680 of 2021(4) dt.06-04-2022 2/2 section 41 (1) of the Code of Criminal Procedure, as mentioned in the impugned order dated 18.02.2021, hence, there is no apprehension of arrest of the petitioner.

Accordingly, the criminal miscellaneous petition is dismissed as not maintainable.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
