JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsels for the petitioners and the State. The petitioners apprehend their arrest in connection with Trial No. 1892/2016, instituted under Section 420 of the Indian Penal Code.
The allegation, in brief, is that the owner of the travel agency Raqib Alam assured the complainant to send him Saudi Arabia to be engaged there and will be paid Rs. 25,000/- to 26,000/- per month and for that Rs. 1,000,00/- was taken by the accused persons. They were taken to Saudi Arabia and worked for eight months but no salary was paid to them.
Learned counsel appearing on behalf of the petitioners submits that only allegation against these two petitioners is that
Patna High Court Cr.Misc. No.6791 of 2017 (3) dt.18-03-2017 2/2 they introduced the complainant to Raqib Alam, owner of the travel agency. The money was also received by him. These petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioners, namely, Babujan @ Shahbad and Mumtaz Mian in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Trial No. 1892/2016; subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
