JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2016 Heard Sri Ajit Kumar Singh, learned counsel for the petitioner and Sri Anil Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 04-04-2016 in Kotwali P.S. Case No. 73 of 2016 registered for offence under Section 290 of the Indian Penal Code and Section 47(A) of the Excise Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was falsely made accused on an allegation of selling country-made liquor. He submits that nearby house of the petitioner, recovery of forty one litres of country-made liquor was shown and petitioner was named as accused with allegation that petitioner fled away, however; immediately after knowing regarding the accusation in the present case, the petitioner suo

Keeping in view nature of accusation and period of custody, let the petitioner namely Dilip Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 73 of 2016.
