JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 304B and 34 of the Indian Penal Code. Allegation against the petitioners is that they along with other family members poured kerosene oil upon the body of daughter of the informant and set her on fire. Thereafter, she was taken to hospital where she was declared dead. It has been submitted on behalf of the petitioners that they are in custody since 29.4.2016. Chargesheet has been submitted against the petitioners. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioners. Petitioner no. 1 is mother-in-law and petitioner no. 2 is dewar of the deceased. They are separate in mess and property from the husband of the deceased. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties

Patna High Court Cr.Misc. No.32301 of 2016 (3) dt.16-09-2016 2/2 of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gopalganj, in connection with Jadopur P.S. Case no. 33 of 2016, G.R. no. 1149 of 2016.
