Petitioner is languishing in custody since 17.05.2016 in connection with Phenhara P.S.Case No.65 of 2015 for offence alleged under Sections 387, 465, 466, 468, 471 and 120B of the IPC and Section 17 of the CLA Act and Sections 10/13 of the U.A.P.Act As per the prosecution case, the informant was given a phone call demanding extortion of money of Rs.5 lacs and in case of failure to pay, he was threatened to be killed. It has been submitted by the learned counsel for the petitioner that the name of the petitioner appeared in the confessional statement of one Manoj Singh who disclosed the
Patna High Court Cr.Misc. No.32655 of 2016 (3) dt.21-12-2016 2/2 name of one more co-accused Sunny Kumar Singh @ Sunny Singh and the said Sunny Kumar Singh @ Sunny Singh has been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No.28912 of 2016 and the case of the petitioner stands on similar footing.
However, learned APP for the State opposes the prayer for bail.
Considering the aforesaid facts and circumstance of the case as also considering that co-accused has been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 12th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Phenhara P.S.Case No.65 of 2015.
