Mr. Ramchandra Sahani, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 30(a), 32(i), 36, 43(a) and 48 of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 20,000 litres of Ethanol were recovered from a tanker standing besides the road and the said Ethanol was to be sold to wine mafia. It is further alleged that the petitioners were standing near the tanker and fled away after seeing the police party but they have been apprehended by the police on chase.

It is urged that petitioner no. 1 is driver, petitioner no.

Patna High Court Cr.Misc. No.58162 of 2018(2) dt.06-10-2018 2/2 2 is khalasi and petitioner no. 3 is the Mistry (Dynamo Mechanic). It is contended that the tanker was carrying 20,000 litres of Ethanol which was being transported after following the due process of law from Harinagar Sugar Mills to Indian Oil Corporation, Barauni for preparation of fuel. Petitioners claim that they are having clean antecedent and are in custody since 20.04.2018.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, West Champaran at Bettiah, in connection with Nautan (Jagdishpur) P.S. Case No. 177 of 2018.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
