JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Hawai Adda P.S.Case No. 38 of 2020 for the offences punishable under Sections 414 of the Indian Penal Code .

It is a case of theft of Bolero vehicle.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner name has been surfaced on the basis of confessional statement of co-accused Mukund Kumar. The vehicle was recovered from possession of co-accused Mukund Kumar not the petitioner. Petitioner has clean antecedent.

Patna High Court CR. MISC. No.29932 of 2021(3) dt.10-03-2022 2/2 Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class,Patna in connection with Hawai Adda P.S Case No. 38 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
