The petitioner apprehends his arrest in Biraul P.S. Case No. 150 of 2016 instituted for the offence under sections 7 of the Essential Commodities Act.
There is allegation against this petitioner that he was caught by villagers, carrying 50 bags of rice of mid-day meal of middle school Nadega, Biraul for black marketing. Learned counsel for the petitioner has pointed out Annexure-3 and 4 which are reports of B.D.O and S.D.O., Biraul wherein it has been stated that on enquiry no any shortage of the rice of mid-day meal was found in the aforesaid school. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Biraul Case No. 150 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Biraul, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr.P.C.
