In this case, the petitioner is seeking regular bail in connection with Uchakagaon P.S. Case No. 200 of 2018, registered for the offences punishable under Sections 302, 120(b) of the Indian Penal Code.

As per allegation, the learned counsel for the petitioner has submitted that there is no allegation against the petitioner to assault the deceased. The allegation of inflicting knife blow on the person of deceased is against co-accused Tohid @ Laddu Khan who has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 4503 of 2020, and the case of the petitioner is on better footing. The petitioner is a person of clean antecedent and under custody since 02.02.2023.

No.20097 of 2023(2) dt.20-04-2023 2/2 Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IV, Gopalganj in connection with Uchakagaon P.S. Case No. 200 of 2018, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
