JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-07-2019 This application under Article 227 of the Constitution of India has been filed by the petitioners for setting aside the order dated 15.01.2019 passed in Title Suit No.286 of 1985 by the learned Sub Judge-11, Patna rejecting the petition filed by the petitioners under Order 1 Rule 10(2) read with Section 151 of the Code of Civil Procedure.
At the outset, it is submitted by Mr. D.K. Sinha, learned senior advocate appearing for the petitioners that during
Patna High Court C.Misc. No.415 of 2019(2) dt.11-07-2019 3/3 pendency of the application, since the suit itself has been decided by the court below, the application has become infructuous.
