ANJANA MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.07.2018 in connection with Andar P.S. Case No.135 of 2018 registered for the offence under Section 7 of the E.C. Act.
The allegation against the petitioner is that a raid was conducted and several bags of food commodities, which were allegedly belonging to the Food Corporation of India, were recovered from his premises. Learned counsel for the petitioner submits that the alleged recoveries were made from an open ground which is near the premises of the PACS and not the personal property of the petitioner. It is further submitted that the entire allegation is false and concocted and the petitioner has been languishing in jail. It is further submitted

In view of the aforementioned facts and circumstances and also because that the petitioner has one antecedent, in which the petitioner has already on bail, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Andar P.S.
