This is a petition for grant of anticipatory bail for offence under Sections 395 and 412 of the Indian Penal Code.

The first information report of dacoity in the house of the informant is against unknown.

Submission of the petitioner is that during the investigation the family members stated that the petitioner was also seen fleeing after committing dacoity. The aforesaid statement is palpably false, otherwise there is no reason to not disclose the name of the petitioner in the first information report. The petitioner has stated on oath that he has got no criminal antecedent.

The learned counsel for the informant opposed

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rajgir P.S. Case No. 137 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, IV, Nalanda at Biharsharif, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
