Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47(A), 53(C) and 54 of the Bihar Excise Act, 1915.
24 bottles each containing 200 milliliters illicit country made liquor are said to have been recovered from the shop, which is said to be of petitioner. However, it is claimed that the petitioner was caught, while he was fleeing away. The petitioner is in jail custody since10.05.2016 and does not have any criminal antecedent.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.31219 of 2016 (2) dt.11-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 131 of 2016.
