JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Konch P.S. Case No. 118 of 2016 registered for the offences punishable under Sections 147, 149, 341, 323, 325, 307, 337, 324, 427, 504 and 506 of the Indian Penal Code.

Allegedly, the petitioner assaulted Surya Mani Devi with Fasuli and Baletha with intention to kill her, resulting, she became unconscious and others assaulted others.

Submission is of false implication and that there is case and counter case vide annexure-2 bearing Konch P.S. Case No. 119 of 2016, the injury found on the person of Surya Mani Devi is simple in nature which is evident from final injury report at page 22 vide annexure-3A and as such the petitioner deserves sympathetic consideration as the occurrence has taken place due to

Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering the final injury report which is simple in nature, the petitioner above named in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Tej Pratap Singh, J. M. Ist class, Gaya in connection with Konch P.S. Case No. 118 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
