JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 2903-2014 in a case registered under Sections-302/34 of the Indian Penal Code.
The postmortem report of the deceased reveals that the deceased sustained two injuries, which are attributed to other named accused persons. So far as the petitioner is concerned; it is stated that he also assaulted the deceased with Lathi but admittedly, only two injuries were found on the person of the deceased at the time of his postmortem examination. Moreover, prior to institution of the present case, when fardbeyan of the informant was recorded at PMCH, she did not make any specific

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maharajganj P.S. Case No. 342 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Siwan.
