JUSTICE SUDHIR SINGH ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 376 and 511 of the Indian Penal Code and 4 & 8 of POSCO Act.

Allegation against the petitioner is of committing rape upon daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 19.2.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. There is admitted land dispute between the parties and for the said reason the present prosecution has been brought against the petitioner. Petitioner denies the allegation made in the F.I.R. It is further submitted that petitioner may be released after completion of nine months in custody, i.e., 19.2.2016. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of

No.28984 of 2016 (3) dt.31-08-2016 2/2 nine months in custody, i.e., from 19.2.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge,Vaishali at Hajipur, in connection with Jandaha P.S. Case no. 23 of 2016.
