The petitioners are apprehending their arrest in connection with Chanpatia P.S.case No.67 of 2016 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 379, 307, 354(A)(B), 506 of the Indian Penal Code. FIR disclose that the allegation against the petitioner and other accused persons is that they caught hold the collar of the informant and the petitioner no.3 and 1 assaulted the informant and when his wife came to save him, the petitioner no.3 and other accused persons assaulted by Farsa causing injury on her head and the petitioner no.1 and other coaccused persons have assaulted his son by Lathi and fists and

Patna High Court CR. MISC. No.20924 of 2019(5) dt.24-06-2019 2/2 slaps. There is further allegation of snatching of golden chain. Submission of the learned counsel for the petitioners is that the allegation is in the background of panchayat election and there is case and counter case between the parties and the injuries are simple in nature.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-Vth, Bettiah, West Champaran in connection with Chanpatiya P.S.Case No.67 of 2016, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
