The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304, 120B, 504/34 of the Indian Penal Code and 3(1)(x)/3(2)(v) of SC/ST (Prevention of Atrocities) Act.

The prosecution case is that the co-accused Samta Yadav dashed the mother-in-law of the informant, who subsequently succumbed to the injuries. It is alleged against the petitioner that the petitioner was sitting in the vehicle which was driven by Samta Yadav.

It is submitted by learned counsel for the petitioner that the specific accusation is against Samta Yadav.

Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that thrust of accusation is against co-accused Samta Yadav, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kasma P.S. Case No. 20 of 2015 pending in the court of learned Chief Judicial Magistrate, Aurangabad.

With the aforesaid observation, this application is disposed of.
