1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 198 / 2023 dated 29.03.2023 registered under Sections 323, 341, 504, 506, 354 of the I.P.C.

As per the first information report on 25.03.2023 while the informant's daughters Dular Kumari and Sanmati Devi were going to attend nature's call, the petitioner who was hiding himself misbehaved with the informant's daughters. The informant's daughters came back and told the occurrence to the informant and the informant went to lodge a complaint before the petitioner's father. The petitioner and his father assaulted the informant's daughters by belt and abused her. It has further been alleged that for the last 4-5 days the petitioner was chasing the informant's daughters, misbehaving and also abusing them.

4. Learned counsel for the petitioner submits that both the parties are co-villagers and due to previous enmity the present F.I.R. has been lodged. The petitioner is having no criminal antecedent and he is aged about 20 years. The F.I.R. in question has been lodged after a delay of four days. The informant's side has also lodged an F.I.R. bearing Belaganj P.S. Case No. 208 / 2023 (Annexure- 2) against the informant and others. The father of the petitioner Sanjay Yadav has been granted anticipatory bail by a co-ordinate bench of this court in Cr. Misc. No. 16523 / 2024 (Annexure:P-3).

Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are co-villagers, case and counter case is there, the petitioner is aged about 20 years having no criminal antecedent accordingly I am inclined to grant anticipatory bail to the petitioner subject to the condition that he will not repeat the same offence in future.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of I/C C.J.M., Gaya in connection with Belaganj P.S. Case No. 198 of
