JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 304B/34 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in course of preparation of food, her sari caught fire. Thereafter, she was taken to P.M.C.H., whereafter to N.M.C.H. and all the family members of the deceased were present there. Later on, the matter has been compromised between the parties.

Patna High Court Cr.Misc. No.4879 of 2017 (2) dt.15-02-2017 2/2 Having heard both sides, on perusal of the impugned order it appears that before the death of the deceased, she had disclosed before the police regarding complicity of the petitioners in the present case. As such, this case is not fit for anticipatory bail.
However, petitioner may surrender in the court below, i.e., learned C.J.M., Jehanabad, in connection with Shakurabad P. S. Case no. 135 of 2015 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
Accordingly, this application is dismissed.
