JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2015 It is submitted by learned counsel for the petitioners that the petitioner no. 2 Sunil Mahto has been arrested, hence, his anticipatory bail application has become infructuous.

Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted with Farsa on the head of the informant whereas co-accused Sunil Mahto assaulted with Iron rod, Shambhu assaulted with lathi causing injury on the nose of the informant, Anil and Jogendra Mahto also assaulted with lathi and Bhuneshwar Mahto took out

Patna High Court Cr.Misc. No.41648 of 2014 (2) dt.23-02-2015 2 / 2 Rs. 20,000/- from the pocket of the informant and Anil Mahto put towel around the neck of the informant and began to press.

It is submitted by learned counsel for the petitioner that only one lacerated injury has been found caused by hard and blunt substance. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the petitioner no. 1 Ajay Kumar, except petitioner no. 2 Sunil Mahto, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Gaighat P.S. Case No. 218 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.

Ist Class, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
