The petitioner apprehends his arrest in a case under Sections 354, 406, 420, 384, 120(B) of the Indian Penal Code. The complainant filed a complaint petition on the basis of which the present F.I.R. was lodged. The complainant alleged that the petitioner happens to be a relative of her husband and, on his persuasion, the informant invested rupees four lakhs in the medicine business of the petitioner but the petitioner did not return the money. One cheque of rupees fifty thousand was issued by Chakraborty Chaudhary in favour of the informant in lieu of payment of the amount invested in the medicine business of the petitioner. It is also alleged that the petitioner took naked photograph of the informant without her knowledge and tried to black-mail her. It is submitted that the entire allegation is false and
Patna High Court Cr.Misc. No.36176 of 2015 (4) dt.04-11-2015 2/3 concocted. The petitioner never persuaded the informant to invest money in his business nor issued any cheque in favour of the informant Sunita Singh. The cheque was issued by Chakraborty Chaudhary.
On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submitted that on the bond paper, the petitioner put his signature accepting the factum of taking loan of rupees two lakhs fifty thousand from the informant.
It appears that some dispute arose between the parties for borrowing and returning of money. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (T) P.S. Case No. 09/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
