This is the second attempt of the petitioner seeking bail, as earlier by order dated 13.10.2020 passed in Cr. Misc. No. 20918 of 2020, the bail application of the petitioner was rejected.

Learned counsel for the petitioner submits that subsequent to rejection of the prayer for bail of the petitioner, certain subsequent development took place and the matter was compromised between the parties. It is submitted that the petitioner was not named in the FIR but his name transpired in the statement under Section 164 Cr.P.C made by the victim. Learned counsel thus submits that the informant and the victim realising their mistake have entered into a compromise dated

Patna High Court CR. MISC. No.30382 of 2021(3) dt.27-04-2022 2/2 08.07.2021 as would be evident from Annexure-3 to the supplementary affidavit.

Learned counsel for the informant confirms the compromise between the parties.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner which is rebutted by the learned counsel for the petitioner submitting that since the parties have compromised, the chances of conviction of the petitioner is very bleak and the petitioner has remained in custody since 28.02.2020 and is a person with clean antecedent. Considering the submissions made by the learned counsel for the petitioner and duly confirmed by the learned counsel for the informant, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jale P.S. Case No. 200 of 2019.
