The petitioner seeks bail in Rohtas P.S. Case No. 221 of 2016, instituted for the offence under Section(s) 147, 148, 149, 341, 323, 384, 504 of the Indian Penal Code, Sections 11 and 17 of U.P.A. Act.

Prayer for bail of the petitioner was earlier rejected by coordinate Bench of this Court vide order dated 16.7.2018 passed in Cr. Misc.28913 of 2018 with liberty to renew his prayer for bail after six months of framing of charge. It is alleged in the written report that 6-7 miscreants armed with deadly weapons came and assaulted the informant and also made demand of levy. They snatched the Mobile Phone of the informant. The informant identified the petitioner and two

Patna High Court CR. MISC. No.23469 of 2019(6) dt.01-08-2019 2/2 other accused persons as named in the written report. Report has been received from the court below which is kept at Flag 'A'. It is mentioned in the report that charge has been framed against the petitioner in the case on 14.8.2018. The case is fixed for evidence.

Counsel for the petitioner submits that petitioner is in custody since 5.10.2017.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Rohtas P.S. Case No. 221 of 2016, subject to the condition that both the bailors will be close relatives of the petitioner.
