The learned counsel for the petitioner submits that twice the bail application of the petitioner was rejected. It is next submitted that it is the case under N.D.P.S. Act and the F.S.L. Report dated 04.07.2022 does not even remotely suggest that the alleged article sent to F.S.L. was a contraband.
The learned Additional P. P. submits that the F.S.L. Report is not on record.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in
Patna High Court CR. MISC. No.20053 of 2023(2) dt.12-04-2023 2/2 the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Muzaffarpur in connection with N.D.P.S. Case No.06 of 2021 arising out of Saraiya P. S. Case No.64 of 2021.
The application stands allowed.
However, the learned trial Court, before releasing the petitioner on bail, shall verify as to whether the F.S.L. Report records that the alleged articles were not contraband article, then the bail bonds of the petitioner shall be accepted. (Satyavrat Verma, J) vikash/- U T
