The present writ application has been filed seeking direction upon the respondents Bihar State Road Transport Corporation, Patna to pay the amount with statutory interest which has been deducted from his salary of the petitioner and deposited with respondent no. 4, Regional Provident Fund Commissioner till 1998 in family pension scheme as well as the amount deducted subsequently by respondent no. 1 to 3. A counter affidavit has been filed on behalf of the respondent no. 1, 2 and 3. From the averments made in the counter affidavit, it appears that the answering respondents took steps for payment of pension dues of the petitioner from August 1988 till their date of retirement with up to date interest and the

Patna High Court CWJC No.9459 of 2021(3) dt.28-11-2022 2/2 same has been paid to them on different date through RTGS in their respective accounts, except petitioner no. 4,7,13, and 21, who are not the member of the scheme.

At this juncture, learned counsel for the petitioner submits that though prima facie from the averments, it appears that the substantive grievance of the petitioner has been redressed, however, if still there is any grievance in connection with any of the petitioner, they may be given liberty to seek appropriate remedy.

In view of the submissions, made on behalf of the parties, the present writ application stands disposed of with a liberty to the petitioners to avail the remedy available under the law or they may file a representation before the competent authority if, any grievance still remains subsist. Accordingly, the present writ application stands disposed of with the aforesaid observation and liberty. (Harish Kumar, J) N.K/- U
