Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 21.12.2019 in Maniyari P.S.Case No. 331 of 2019 registered under sections 399, 402, 414, 467, 471 of the Indian Penal Code and 35 of the Arms Act.

Petitioner is said to have been arrested when he along with others had assembled to make preparation for committing dacoity and on being searched, one cartridge is said to be recovered. Petitioner does not have any criminal antecedent and, moreover, the first information report has not been lodged under section 25 of the Arms Act.

No.20721 of 2020(2) dt.04-09-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Muzaffarpur in connection with Maniyari P.S. Case No. 331 of 2019.
