JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is that he fired shot upon brother of the informant. One another unknown accused also fired shot upon brother of informant. Thereafter, he died. Earlier bail application of petitioner was rejected vide Cr. Misc. no. 1995 of 2015. This is the second attempt for bail filed on behalf of petitioner. A report was called for from the trial court. It has been reported that out of ten witnesses, six witnesses have already been examined and trial is expected to be concluded within a period of two months.

Considering the aforesaid facts and circumstances, I am

Patna High Court Cr.Misc. No.37196 of 2016 (4) dt.08-12-2016 2/2 not inclined to grant bail to petitioner at this stage, same is rejected.
