JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Budha Colony P.S. Case No. 307 of 2016 instituted for the offence under sections 406, 420/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
It is alleged that a talk of marriage of the daughter of the informant with this petitioner had taken place and accordingly, 'Ring Ceremony' was also performed. Thereafter, an amount of Rs. 15 lakhs was paid to the family members of the petitioner, out of which Rs. 1,50,000/- was paid to the father of this petitioner by cheque.
It has further been alleged that money has been paid in cash also to the father of this petitioner. Ultimately, marriage broke down.
Patna High Court Cr.Misc. No.9263 of 2017 (3) dt.07-03-2017 2/2 Counsel for the informant has appeared. He has admitted that he has received Rs. 1.50,000/-from the father of this petitioner by cheque. With regard to payment of further amount of Rs. 13,0000/-, it has been submitted that no any documentary proof is available with informant. The entire talk of marriage was done by the informant with father of this petitioner. It has been submitted that father of the petitioner has already been granted anticipatory bail by a coordinate Bench of this court in Cr. Misc. No. 6548 of 2017 vide order dated 10.2.2017.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Budha Colony P.S. Case No. 307/2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
