JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-09-2018 The petitioner seeks regular bail in connection with Koilwar P.S. Case No. 294 of 2017, registered for offences punishable under Sections 341, 323, 504, 379, 304, 34, 354(A) and 302 of the Indian Penal Code.

Allegation against the petitioner and others is that they entered inside the house of the informant and assaulted him by means of lathi, danda and dab and also threw the daughter in law of the informant into well, due to which she sustained injuries and died during course of her treatment.

It has been submitted on behalf of the petitioner that only genera and omnibus allegation has been attributed to him and no specific allegation has been levelled. He has been in judicial custody since 09.03.2018 and other co-accused persons have been enlarged on bail by a coordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.57931 of 2018 (2) dt.28-09-2018 2/2 dated 01.08.2018 passed in Cr. Misc. No. 42909 of 2018. Heard learned A.P.P. also.

Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Koilwar P.S. Case No. 294 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
