The petitioner seeks bail in a case registered for offences punishable under Section 47A of the Bihar Excise (Amendment) Act, 2016.

It is alleged that about 13 litres country-made liquor and 14 litres foreign liquor were recovered from the shop of the petitioner.

It is contended that the recovery was made on the subsequent date when the amended provision of Section 47A of the Bihar Excise Act were made applicable. Petitioner was apprehended and he has been remanded in custody. However, it has been contended that petitioner does not have any criminal

Patna High Court Cr.Misc. No.26610 of 2016 (2) dt.14-07-2016 2/2 antecedent and chargesheet has already been submitted in this case.

Having regard to the facts and circumstances of the case, the petitioner, namely, Sujan Mahto is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate II, Sheikhpura in Barbigha P.S. Case No. 109 of 2016.

If the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
