The petitioner apprehends his arrest in Wazirganj P.S. Case No. 228 of 2016 instituted for the offences under Sections 147, 148, 149, 452, 341, 323, 325, 307, 354, 427 and 379 of the Indian Penal Code and under Section 27 of Arms Act. It is alleged against this petitioner in the written report that he assaulted the brother of the informant Abhay Mishra with iron road on his head causing injury to him. The injury report has been discussed in the impugned order by the learned Sessions Judge where it has been mentioned that Abhay Mishra sustained incised wound on the vertex of skull, size 2.5"x1.5"x1". Patna High Court Cr.Misc. No.1417 of 2017 (2) dt.17-01-2017 2/2 filed at page-15 of the bail petition wherein doctor has kept his opinion reserved and patient was sent to J.P.N. Hospital, as such from written report itself it appears that there is allegation of single blow, no repetition of blow. Doctor has found injury of the size 2.5"x1.5"x1". Therefore, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Wazirganj P.S. Case No. 228 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya, subject to the conditions as laid down under Section 438(2) Cr.P.C.
