Petitioner seeks bail in connection with Bidupur P.S. Case No. 124 of 2018 registered for the offence punishable under sections 379 and 414 of the Indian Penal Code and Sectioni 25(1)a/26 Arms Act.
Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 40479 of 2018, which was rejected vide order dated 17.07.2018 (Annexure-3) with observation that the petitioner may renew prayer of bail after framing of charge. Learned counsel appearing for the petitioner submits that in this case, charge has been framed against this petitioner vide order dated 27.08.2018 (Annexure-4) passed by the learned court of ACJM-XIV, Vaishali at Hajipur. Patna High Court Cr.Misc. No.58381 of 2018(2) dt.28-09-2018 2/2 has no criminal antecedent and is in custody since 12.05.2018. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 124 of 2018.
