JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Since both cases arise out of Madhuban P.S. Case no. 23 of 2016, they have been heard together and are being disposed of by this common order.

The petitioners seek bail in a case instituted under Section 395 of the Indian Penal Code.

Allegation is 5/6 unknown persons have looted all valuable articles from the house of the informant on the point of pistol.

It has been submitted on behalf of the petitioners that they are in custody since 2.2.2016. Chargesheet has been submitted against the petitioners. They have got no criminal

Patna High Court Cr.Misc. No.26206 of 2016 (3) dt.18-08-2016 2/2 antecedent. They are not named in the F.I.R. The alleged occurrence is said to have taken place at 11 in the night. No source of identification has been disclosed. The T.I.P. is said to have taken place at police station and the articles recovered are said to be looted articles. No procedure of T.I.P. has been followed in this case. It is further submitted that petitioners may be released after completion of nine months in custody from 2.2.2016.

On behalf of the State, it is submitted that petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail after completion of nine months in custody from 2.2.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Madhuban P.S. Case no. 23 of 2016.
