Petitioner, who is in custody, seeks bail in connection with Laxmipur (Gidhaur) P.S. Case No. 174 of 2018 registered for the offences punishable under Section 392 of the Indian Penal Code.

Informant has alleged that when he was returning after collection of money, three miscreants came on motorcycle and thereafter on strength of pistol looted Rs. 13,300/- of daily collection and Rs. 5,700/- of LIC collection and also snatched his mobile.

It has been submitted on behalf of petitioner that he is innocent and has committed no offence. Petitioner is not named in FIR. Nothing has been recovered against him except

Patna High Court Cr.Misc. No.57990 of 2018(2) dt.05-10-2018 2/2 one mobile which belongs to petitioner. The motorcycle which has been recovered from possession of petitioner belongs to Ratan Kumar Tanti. He has no criminal antecedent and except his self confession there is no incriminating material against him.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sumit Kumar Singh, learned J.M. 1st Class, Jamui in connection with Laxmipur P.S. Case No. 174 of 2018.
