Despite valid service of notice, none appears for the opposite party no.2.

This is the second attempt on behalf of the petitioner for grant of bail in connection with Chandramandi P.S. Case No.200 of 2024 registered fro the offence under sections 137(2), 103(1), 283 and 3(5) of the B.N.S., 2023. 4.
Earlier, the prayer of the petitioner for grant of bail has been rejected by this Court vide order dated 23.07.2025 passed in Criminal Miscellaneous No.13851 of 2025.

It is alleged that the petitioner was having an affair with the deceased. On 25.10.2024 at about 9:00 P.M. the petitioner called the deceased at her house and when the deceased reached there, the father-in-law of the petitioner and others have killed him and thereafter disposed of his body under a bridge.

The petitioner is in custody since 28.10.2024.

It has been submitted by learned counsel for the petitioner that the petitioner is a woman and has falsely been implicated in this case. It has also been submitted that in the trial out of 30 witnesses, only 5 witnesses have been examined and the last witness has been examined on 25.11.2025 and thereafter no witness has been examined in the trial till date. 8.
Learned APP for the State has vehemently opposed the prayer of the petitioner for grant of bail. 9.
Considering the fact that the petitioner is a woman, her period of custody and also the fact that in the trial out of 30 witnesses, only 5 witnesses have been examined till date, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)
Patna High Court CR. MISC. No.19700 of 2026(3) dt.02-07-2026 3/3 with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, V, Jamui / concerned Court below, in connection with Chadramandi P.S. Case No.200 of 2024.

This is also subject to the condition that she will cooperate in the trial and will appear herself or through her advocate on each and every date fixed in the trial. Failure to appear in the trial on two consecutive dates, will result in cancellation of the bail bonds of the petitioner by the Court below.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
