The petitioner is apprehending arrest in a case registered for the offences punishable under section 379 of the Indian Penal Code.
On commission of theft of Bolero vehicle of the informant FIR was registered against unknown. Name of the petitioner sprang up during investigation when he was sought to be remanded from K. Hat (Maranga) P.S. Case No. 245 of 2013 but before he could be remanded he was directed to be released in the connected case.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.35727 of 2015 (2) dt.04-09-2015 2/2 petitioner that subsequently the informant filed a petition denying the levelling of accusation against the petitioner. The impugned order does not suggest any material as against the petitioner except that the petitioner confessed in the connected case that he is involved in the other case.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Katihar (Sahayak) P.S. Case No. 268 of 2013 pending in the court of learned CJM, Katihar. This application is disposed of with the aforesaid observation/direction.
