====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of UCO Bank.

Learned counsel appearing on behalf of Bank informed the Court that the auction schedule has failed and now the Bank is contemplating taking fresh process for auction of the house of the petitioner despite the fact that the petitioner is ready to repay the loan amount.

Learned counsel for the petitioner submits that despite pandemic of Covid-19 petitioner is honestly trying to repay the loan amount but the Bank is not considering the same in right perspective.

Learned counsel for the petitioner submits that in fact there is error in the calculation of the dues. He submits that the

Patna High Court CWJC No.8568 of 2021(2) dt.08-04-2021 2/2 petitioner has paid substantial amount but the same has not been properly entered in the account of the Bank.

Without going into the thicket of controversy as to calculation, the writ application is disposed of with liberty to the petitioner to approach the Authorized officer-cum-Chief Manager, UCO Bank, Begusarai along with copy of this order within a period of 15 days and will submit his proposal for repayment of the loan amount of the Bank. The Bank is expected to provide the detailed chart of calculation and mode of repayment so that the petitioner may arrange money for repayment of the housing loan. The Bank will also consider the hardship of the petitioner on account of pandemic and fix installment so that the due amount may be paid to the Bank. The appropriate decision on the representation filed by the petitioner will be taken by the authorized officer, UCO Bank within a period of one month from the date of filing of such proposal along with a copy of this order.

With the aforesaid, this writ application stands disposed of.
