1. The present writ petition has been filed seeking the following relief(s):- "1. I) For a direction to the respondents to grant benefit of Assured career Progression / Modified Assured career Progression (hereinafter referred to as A.C.P./M.A.C.P. for short) to the petitioner, by counting his entire length of service with effect from February 1985 till his date of retirement dated 3107-2021, in terms with the provision contained in Rule 22 of the MACP Rules, 2010.

II) Thereby, prayer is for a direction to the respondents to grant 1st A.C.P. to the petitioner with effect from 09-08- 1999. Similarly 2nd M.A.C.P be granted to the petitioner with effect

Patna High Court CWJC No.4999 of 2024(2) dt.04-04-2024 2/2 from 01-01-2009 alongwith its consequential monetary benefit and arrears thereof, by making his pay fixation in the grade pay of Rs. 4600.

Further prayer is to allow 3rd MACP to the petitioner with due date, on completion of 30 years of his service alongwith the consequential monetary benefit and arrears thereof, by making his pay fixation in the next higher grade pay of Rs. 4800 and accordingly make re- fixation of his pension and other retiral benefits."

2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Darbhanga, for redressal of his aforesaid grievances. Liberty so sought is granted.

3. It is needless to state that in case appropriate representation is filed by the petitioner, before the District Magistrate, Darbhanga, within a period of two weeks from today, the same shall be considered, in accordance with law and a reasoned and a speaking order shall be passed, thereon, within a period of six weeks, thereafter.

4. The writ petition stands disposed off on the aforesaid terms.
