====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 30-06-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 420, 469, 468, 471 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a lady and is a person with clean antecedent and the informant alleges that mark-sheet of the petitioner of Madhyama was found forged as was communicated by the Bihar Sanskrit Education Board when the matter was verified. Learned counsel for the petitioner submits that petitioner had appeared in Madhyama Examination and has submitted her certificate based on which she got an appointment. It is next alleged that petitioner was working as a
Patna High Court CR. MISC. No.20238 of 2022(2) dt.30-06-2022 2/2 Panchayat Teacher from 30.11.2007 and the present FIR came to be instituted on 05.11.2021. It is next submitted that entire inquiry was conducted behind the back of the petitioner for which no opportunity was given to her to defend her case. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Jalley P.S. Case No. 155 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
