JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.04.2015 in a case registered for the offences punishable under Sections 414, 467, 468, 471/34 of the Indian Penal Code.

No doubt, petitioner is named in the first information report and informant claimed that petitioner had gone to meet his father in law and after that the house of father in law of the petitioner was raided and one stolen motorcycle was recovered and thereafter on the basis of disclosure made by the petitioner anther stolen motorcycle was recovered from the house of one Kaushal Kumar.

Patna High Court Cr.Misc. No.36835 of 2016 (2) dt.05-09-2016 2/2 Submission on behalf of the petitioner is that the said recovery has not been made from conscious possession of the petitioner and co-accused, Kaushal Kumar, having more or less similar allegation, has already been granted privilege of bail by a co-ordinate Bench of this Court.

No doubt, petitioner carries criminal antecedent of several cases but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka in connection with Kundwa Chainpur P.S.
