Petitioner prays for bail in connection with Konch P.S.Case No. 05 of 2018 registered for the offences punishable under Sections 341, 323, 328 and 304B/34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be 'Debar' of the deceased, is of causing dowry death. Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and petitioner is in custody since 3.7.2018 and charge sheet has been
Patna High Court Cr.Misc. No.58083 of 2018 (2) dt.08-10-2018 2/2 submitted in this case. Further submission is that co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 13.7.2018 passed in Cr.Misc.No. 36922 of 2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Gaya, in connection with Konch P.S.Case No. 5 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
