====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Excise Case No. 01 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise Act, 2016, Sections 8 and 20 of Narcotic Drugs and Psychotropic Substances Act, 1985.

It is alleged in the written report that two bottles of 180 ml. of foreign liquor and 1.5 litres of Crazy Romeo liquor including 1.500 k.g. of Ganja have been recovered from possession of the petitioner.

Counsel for the petitioner submits that there is no compliance of provisions of Section 50 of NDPS Act in preparing the seizure list.

Patna High Court CR. MISC. No.19200 of 2019(2) dt.29-03-2019 2/2 From the prosecution report it appears that the seizure list bears signature of the Excise Officials. Petitioner is in custody since 5.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd-cum-Special Judge (Excise), Rohtas at Sasaram, in connection with Excise Case No. 01 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
