1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Rajpur P.S. Case No. 352 of 2022 dated 09.12.2022 registered for the offence(s) punishable under Section(s) 120(B), 304(B) and 326 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is the cousin father-in-law of the deceased, as per the statements of material witnesses recorded during investigation the petitioner started living at Sasural of his daughter after the death of his wife and he is an old person and in the FIR the informant only suspected the death of his daughter having been committed by the accused persons including the petitioner by poisoning the victim and

Patna High Court CR. MISC. No.20057 of 2023(3) dt.03-08-2023 2/2 two co-accused persons, namely, Sarita Devi and Binod Singh @ Dhaneshwar Yadav have been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.39592 of 2023 and petitioner has been languishing in jail since 09.12.2022.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's old age as well as his custody period and his relationship with the deceased and also the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Rajpur P.S. Case No. 352 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
