====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 13.04.2016 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

On information that the petitioner and his brother Dileep are indulging in sale of Ganja, the battle shop of the petitioner was raided and from Tin box, 3.2 kgs ganja and from cartoon, 1.5 kgs ganja total weighing 4.7 kgs were recovered whereas on the statement of the petitioner, his brother Dilip Singh's stationary shop was raided from where, 1.2 kgs ganja and cash of `5,170/- were recovered.

It is submitted by the learned counsel for the petitioner that the recovery is between small and commercial quantity. A

Patna High Court Cr.Misc. No.35028 of 2016 (4) dt.22-09-2016 2/2 statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, investigation has already concluded.

Mr. Ashok Kumar, learned counsel for the State does not dispute the quantum of recovery.

Considering the recovery between small and commercial quantity, investigation being concluded and statement made in para 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Madhepura in connection with alamnagar P.S. Case No. 45 of 2016.

Learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in similar nature of offence. (Dinesh Kumar Singh, J) Amrendra/- U T
